We aim to comply with applicable UK data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, as amended where applicable.

Where CHART processes information on behalf of an organisational client, the respective data protection responsibilities will depend on the nature of the service and the arrangements agreed between the parties.
Data Protection Principles
We aim to ensure that personal information is:
- Processed lawfully, fairly and transparently.
- Collected for specified and legitimate purposes.
- Limited to what is necessary for those purposes.
- Accurate and kept up to date where necessary.
- Retained only for as long as required.
- Protected through appropriate security measures.
- Handled in a manner that supports accountability and compliance.
Types of Personal Information
Depending on the service, we may process names, contact details, job titles, organisational information, booking records, attendance information, correspondence, invoices and payment records.
Because CHART works in safeguarding, consultation and supervision, some engagements may involve sensitive information or information relating to safeguarding cases.
We seek to avoid collecting unnecessary personal information about children, vulnerable adults or other third parties. Where such information is necessary for a legitimate professional purpose, it must be handled through an appropriate process with suitable safeguards.
Lawful Basis for Processing
We identify an appropriate lawful basis before processing personal information. Depending on the circumstances, this may include:
- Performance of a contract or steps taken before entering into a contract.
- Compliance with a legal obligation.
- Legitimate interests pursued by CHART or another party.
- Consent, where appropriate and legally required.
- Protection of vital interests in applicable circumstances.
- Public task, where applicable and supported by law.
Where special category data is involved, an additional condition under data protection law must also apply. Criminal offence data is subject to separate requirements.
We do not assume that the sensitive nature of safeguarding information automatically permits its collection or disclosure.
Information Sharing and Confidentiality
Personal information is shared only where there is an appropriate legal basis and the sharing is necessary for the relevant purpose.
Information may be shared with authorised service providers, commissioning organisations, professional advisers or public authorities where appropriate.
Safeguarding-related information may need to be shared to protect a child or adult at risk, meet a legal obligation or address another lawful and necessary purpose.
Information-sharing decisions should be proportionate, properly considered and documented where appropriate. Confidentiality obligations do not prevent lawful safeguarding disclosures.
Data Security
We take reasonable steps to protect personal information, including appropriate access controls, secure systems, careful handling of documents and restricted access to confidential material.
Personal information should not be shared through insecure channels where a more appropriate secure method is available.
Staff, associates and service providers who have access to personal information should understand their responsibilities and follow applicable confidentiality and security procedures.
Data Breaches
Suspected loss, unauthorised access, disclosure or misuse of personal information should be reported promptly through the appropriate internal process.
We will assess the circumstances, take steps to contain and investigate the incident, and determine whether notification to affected individuals or the Information Commissioner’s Office is required by law.
Where a reportable personal data breach occurs, applicable legal notification deadlines will be followed.
Data Retention
Personal information is retained according to its purpose, applicable legal obligations, contractual requirements and relevant professional considerations.
Retention arrangements should be documented where appropriate. Information that is no longer required should be securely deleted or anonymised, subject to any lawful reason for continued retention.
Individual Rights
Individuals may have rights under data protection law to access their information, correct inaccuracies, request erasure or restriction, object to certain processing and obtain data portability where applicable.
These rights are subject to legal conditions and exceptions. We will respond to valid requests within the applicable statutory time limits.
Requests can be made using the contact details above.
International Transfers
If personal information is transferred outside the United Kingdom, we will assess the applicable legal requirements and implement an appropriate transfer mechanism or safeguard where required.
Training and Accountability
We aim to ensure that anyone handling personal information on behalf of CHART understands the importance of confidentiality, secure information handling and appropriate data sharing.
Relevant processes and this policy will be reviewed when our services, systems or legal obligations change.
