Introduction
These Terms & Conditions govern the use of the CHART Safeguarding, Law & Training Ltd (“CHART”, “we”, “our” or “us”) website and the services we provide.
By accessing our website, making a booking or engaging our services, you agree to the terms applicable to your use of the website or service.
If you are booking on behalf of an organisation, you confirm that you are authorised to act on its behalf.
Our Services
CHART provides professional safeguarding training, bespoke organisational training, safeguarding consultation, professional supervision and safeguarding-related information and updates.
Services may be delivered face-to-face, through Microsoft Teams or by another arrangement agreed with the client.
The precise scope, format, duration, fees and delivery arrangements will be confirmed during the enquiry or booking process.
Bookings and Confirmation
Training sessions, consultations and other services are subject to availability.
A booking will be considered confirmed when CHART has accepted the booking and communicated confirmation to the client, together with any applicable payment or administrative requirements.
For commissioned organisational training, the agreed proposal, quotation or written service agreement may set out additional terms.
Clients are responsible for providing accurate booking information and ensuring that participants receive the relevant joining instructions and information before the session.
Fees and Payment
Applicable fees will be communicated before a booking is confirmed.
Payment terms, including any deposit, invoicing arrangements and payment deadlines, will be confirmed in the relevant quotation, invoice or booking agreement.
Where payment is overdue, CHART may take reasonable steps to recover outstanding amounts and, where contractually permitted, suspend further services after giving appropriate notice.
Any applicable taxes and additional charges will be communicated where relevant.
Cancellation, Rescheduling and Refunds
Cancellation and rescheduling requests must be submitted in writing using the contact details provided by CHART.
The applicable cancellation notice periods, charges, refund arrangements and rescheduling conditions will be those communicated at the time of booking or set out in the relevant service agreement.
If CHART needs to cancel or reschedule a session, we will contact the client and explain the available arrangements.
Please refer to our separate Cancellation Policy for further information.
Nothing in these Terms & Conditions excludes any rights that cannot lawfully be excluded, including applicable consumer rights.
Client Responsibilities
Clients and participants are expected to:
- Provide accurate and complete information relevant to the service.
- Attend sessions punctually and follow the agreed arrangements.
- Behave respectfully towards the trainer, consultant and other participants.
- Maintain the confidentiality of sensitive discussions and personal information.
- Use training materials only for permitted purposes.
- Follow applicable organisational safeguarding, confidentiality and information-sharing procedures.
Organisations commissioning training remain responsible for their own safeguarding arrangements, policies, decisions and statutory duties.
Training and Professional Advice
Our training and professional services are intended to support learning, reflection and professional practice.
Training materials and discussions provide general educational and professional information within the agreed scope of the service. They do not automatically replace case-specific legal advice, statutory guidance, local safeguarding procedures or advice from an appropriately qualified professional.
Participants and organisations remain responsible for applying learning appropriately to their own circumstances.
Where a consultation has been commissioned for a specific purpose, the agreed scope of work will determine the nature and limits of the service.
Certificates and Attendance
Where a certificate is offered, its issue may depend on meeting the attendance, participation or completion requirements communicated for the relevant session.
Participants are responsible for providing accurate details required for certificate administration.
A certificate confirms the training completed; it does not, by itself, guarantee professional competence, a particular qualification or regulatory approval unless expressly stated.
Intellectual Property
Unless otherwise stated, the website content, training materials, presentations, documents, graphics and other resources provided by CHART remain the intellectual property of CHART or their respective rights holders.
Materials supplied for personal or organisational learning may be used only within the scope of the permission granted.
You must not reproduce, publish, distribute, sell or commercially exploit these materials without prior written permission, except where permitted by law.
Confidentiality and Safeguarding
We respect the confidentiality of information shared during our work. However, confidentiality is not absolute.
Information may need to be disclosed where required by law, where necessary to address a safeguarding concern, or where another lawful and appropriate basis for disclosure applies.
Any information-sharing decision will be considered in accordance with relevant legal requirements, professional responsibilities and applicable safeguarding procedures.
Website Use
You agree not to misuse our website, attempt unauthorised access to systems, introduce malicious software or use the website for unlawful purposes.
We may update, suspend or remove website content where reasonably necessary.
We aim to keep website information accurate and current but cannot guarantee that every page will always be complete, uninterrupted or error-free.
Liability
CHART will provide its services with reasonable care and skill.
To the extent permitted by law, CHART will not be responsible for losses arising from the inappropriate application of general training information, decisions made independently by participants or organisations, or circumstances beyond our reasonable control.
Nothing in these Terms & Conditions excludes or limits liability where exclusion or limitation is prohibited by law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any applicable statutory rights that cannot be excluded.
Any further limitation of liability must be expressly agreed in writing where appropriate and lawful.
Third-Party Services
Our services may use third-party platforms, including Microsoft Teams or other providers. Use of those platforms may be subject to their own terms and privacy policies.
We are not responsible for third-party services beyond the extent of our own legal responsibilities.
Changes to These Terms
We may update these Terms & Conditions when necessary. The current version will be published on our website.
Changes to an existing booking or service agreement will be handled in accordance with the applicable agreement and relevant law.
Governing Law
These Terms & Conditions are governed by the laws of England and Wales, unless applicable law requires otherwise. Any dispute will be subject to the jurisdiction of the courts determined by applicable law.
